تَجْوِيزُهُits permissibility

Its permissibility,

وَهِيَand itمِنْis fromقَبِيلِthe category ofتَسْلِيمِconcedingالْعِلَّةِthe causeوَإِظْهَارِand highlightingالْمَانِعِthe preventer,

and it is of the category of conceding the cause and highlighting the preventer,

فَالْمَعْنَىso the meaningأَنَّis thatالْقِتَالَfightingفِيinالشَّهْرِthe monthالْحَرَامِsacredكَبِيرٌis a greatشَدِيدٌsevere matter

so the meaning is that fighting in the sacred month is a great and severe matter

وَلَكِنَّbutالْفِتْنَةَpersecutionأَشَدُّis more severeمِنْهُthan it,

but persecution is more severe than it,

فَجَازَso it became permissibleفِيinمُقابَلَتِهَاresponse to it,

so it became permissible in response to it,

وَهَذَاand thisالتَّوْجِيهُguidance / interpretationظَاهِرٌis apparentمِنْfromسِيَاقِهَاits contextكَمَاasلَاnotيَخْفَىit is hidden.

and this interpretation is apparent from its context as is not hidden.

٥5آيَةُVerse ofالْمَتَاعِprovisionإِلَىforالْحَوْلِa year:

5 - Verse of provision for a year:

وَقَوْلُهُAnd His sayingتَعَالَىExalted is He:وَالَّذِينَ"And those whoيُتَوَفَّوْنَare taken in deathإِلَىtoقَوْلِهِHis sayingإِلَىforالْحَوْلِa year"

And His - Exalted is He - saying: 'And those who are taken in death' - to His saying - 'for a year'

مَنْسُوخَةٌis abrogatedبِالْمِيرَاثِby inheritance,وَالسُّكْنَىand residenceبَاقِيَةٌremainsعِنْدَaccording toقَوْمٍsome people.

is abrogated by inheritance, and residence remains according to some people.

مَنْسُوخَةٌabrogatedعِنْدَaccording toآخَرِينَothersبِحَدِيثِby the hadith:لَا"There is noسُكْنَىresidenceإِلَخْetc."

Abrogated according to others by the hadith: "There is no residence etc."

قُلْتُI say:

I say:

هِيَit isكَمَاasقَالَhe said:مَنْسُوخَةٌabrogatedعِنْدَaccording toجُمْهُورِthe majority ofالْمُفَسِّرِينَthe exegetes

it is as he said: abrogated according to the majority of the exegetes

وَيُمْكِنُand it is possibleأَنْthatيُقَالَit be said:يُسْتَحَبُّit is recommendedأَوْorيَجُوزُpermissibleلِلْمَيِّتِfor the deceasedالْوَصِيَّةُto make a bequest

and it is possible that it be said: it is recommended or permissible for the deceased to make a bequest

وَلَاand it isيَجِبُnot obligatoryعَلَىuponالْمَرْأَةِthe womanأَنْthatتَسْكُنَshe resideفِيinوَصِيَّتِهِhis bequest,

and it is not obligatory upon the woman that she reside in his bequest,

وَعَلَيْهِand upon thatابْنُis IbnعَبَّاسٍAbbasرَضِيَmay Allah be pleasedاللَّهُwithعَنْهُhim,

and upon that is Ibn Abbas - may Allah be pleased with him -

وَهَذَاand thisالتَّوْجِيهُinterpretationظَاهِرٌis apparentمِنَfromالْآيَةِthe verse.

and this interpretation is apparent from the verse.

٦6آيَةُVerse ofالْمُحَاسَبَةِreckoningعَلَىuponالْبَاطِنِthe inwardوَالظَّاهِرِand the outward:

6 - Verse of reckoning upon the inward and the outward:

وَقَوْلُهُAnd His sayingتَعَالَىExalted is He:وَإِنْ"And ifتُبْدُواyou revealمَاwhat isفِيinأَنْفُسِكُمْyour soulsأَوْorتُخْفُوهُconceal it,يُحَاسِبْكُمْAllah will call you to accountبِهِfor itاللَّهُby Allah"

And His - Exalted is He - saying {And if you reveal what is in your souls or conceal it, Allah will call you to account for it}

مَنْسُوخَةٌis abrogatedبِقَوْلِهِby His saying:لَا"Allah does notيُكَلِّفُburdenاللَّهُa soulنَفْسًاexceptإِلَّاwithinوُسْعَهَاits capacity"

is abrogated by His saying: {Allah does not burden a soul except within its capacity}

قُلْتُI say:

I say:

هُوَitمِنْis fromبَابِthe category ofتَخْصِيصِspecifyingالْعَامِّthe general,

it is from the category of specifying the general,

بَيَّنَتِhas clarifiedالْآيَةُthe laterالْمُتَأَخِّرَةُverseأَنَّthatالْمُرَادَthe intentمَاis what isفِيinأَنْفُسِكُمْyour soulsمِنَofالْإِخْلَاصِsincerityوَالنِّفَاقِand hypocrisy,

the later verse has clarified that the intent is what is in your souls of sincerity and hypocrisy,

لَاnotمِنْofأَحَادِيثِthe whispersالنَّفْسِof the soulالَّتِيwhichلَاhave noاخْتِيَارَchoiceفِيهَاin them,

not of the whispers of the soul which have no choice in them,

فَإِنَّfor indeedالتَّكْلِيفَobligationلَاis notيَكُونُexceptإِلَّاinفِيمَاthat whichهُوَisفِيwithinوُسْعِthe capacity ofالْإِنْسَانِman.

for indeed obligation is only in that which is within the capacity of man.
