الْخَامِسُThe fifth::قَوْلُThe sayingمِنْofيَقُولُthose who say::إِنَّthatالْلَّفْظَthe termبَاقٍremainsعَلَىonمَعْنَاهُits meaningفِيinاللُّغَةِthe language،,وَلَكِنَّbutالْشَّارِعَthe legislatorزَادَaddedفِيهِto itأَحْكَامًاrulings
The fifth: the saying of those who say: that the term remains on its meaning in the language, but the legislator added rulings to it.
السَّادِسُThe sixth::قَوْلٌThe sayingمِنْofيَقُولُthose who say::إِنَّthatالْشَّارِعَthe legislatorاسْتَعْمَلَهُused itفِيinمَعْنَاهُits meaningالْمَجَازِيِّfigurative،,فَهُوَis thereforeحَقِيقَةٌa true meaningشَرْعِيَّةٌlegislative،,مَجَازٌmetaphorلُغَوِيٌّlinguistic
The sixth: the saying of those who say: that the legislator used it in its figurative meaning, therefore it is a true legislative meaning, a linguistic metaphor.
السَّابِعُThe seventh::قَوْلٌThe sayingمِنْofيَقُولُونَthose who say::إِنَّهُthat itمَنْقُولٌis transmitted
The seventh: the saying of those who say: that it is transmitted.
فَهَذِهِThese areسَبْعَةٌsevenأَقْوَالٌsayings::الأَوَّلُThe first::قَوْلٌthe sayingمِنْofيُنَازِعُthose who disputeفِيinأَنْthatمَعْنَاهُits meaningفِيinاللُّغَةِthe languageالتَّصْدِيقُis affirmation،,وَيَقُولُونَand they say::لَيْسَit is notهُوَitالتَّصْدِيقُthe affirmation،,بَلْbutبِمَعْنَىmeaningالإِقْرَارِacknowledgmentوَغَيْرِهِand others.قَوْلُهُمْTheir saying::إِجْمَاعٌConsensusأَهْلِof the peopleاللُّغَةِof the languageقَاطِبَةٌin totalعَلَىthatأَنْthatالإِيمَانَfaithقَبْلَbeforeنُزُولِthe revelationالْقُرْآنِQuranهُوَisالتَّصْدِيقُaffirmation.فَيُقَالُIt is said to him::مِنْwhoنَقَلَtransmittedهَذَاthisالإِجْمَاعَconsensus?وَمَنْAnd whoأَيْنَwhereيَعْلَمُis it knownهَذَاthisالإِجْمَاعَconsensus?وَفِيAnd inأَيِّwhichكِتَابٍbookذُكِرَwas mentionedهَذَاthisالإِجْمَاعَconsensus?
These are seven sayings: The first: the saying of those who dispute that its meaning in the language is affirmation, and they say: it is not affirmation, but meaning acknowledgment and others. Their saying: the consensus of all the people of the language that faith before the revelation of the Quran is affirmation. It is said to him: who transmitted this consensus? And where is this consensus known? And in which book was this consensus mentioned?
الثَّانِيThe second::أَنْthatيُقَالُit is said::أَتَعْنِيDo you meanبِأَهْلِby the peopleاللُّغَةِof the languageنَقَلَتْهَاwho you quotedكَأَبِيlike AbuعَمْرٍوAmr,،,وَالأَصْمَعِيُّand Al-Asma'iوَالخَلِيلُand Al-Khalilوَنَحْوَهُمْand others like themأَوْorالْمُتَكَلِّمِينَthose who speakبِهَاwith it?فَإِنْIfعَنَيْتَyou meantالأَوَّلَthe first،,فَهَؤلاءthen theseلاdo notيُنْقَلُونَtransmitكُلَّeverythingمَاthatكَانَwasقَبْلَbeforeالإِسْلَامِIslamبِإِسْنَادٍwith a chain of narrationوَإِنَّمَاand ratherيُنْقَلُونَthey transmitمَاwhatسَمِعُوهُthey heardمِنْfromالْعَرَبِthe Arabsفِيinزَمَانِهِمtheir time،,وَمَاand whatسَمِعُوهُthey heardفِيinدَوَاوِينِthe anthologiesالشِّعْرِof poetryوَكَلَامِand speechالْعَرَبِof the Arabsوَغَيْرِand otherذَٰلِكَthatبِالإِسْنَادِwith a chain of narration,,وَلَاand do notنَعْلَمُwe knowفِي مَاin whatنَقَلُوهُthey transmittedلَفْظَthe termالإِيمَانَfaithفَضْلًا, in additionعَنْtoأَنْthatيَكُونُواthey becameأَجْمَعُواunited on it.وَإِنْAnd ifعَنَيْتَyou meantالْمُتَكَلِّمِينَthe speakersبِهَذَاof thisالْلَّفْظَtermقَبْلَbeforeالإِسْلَامِIslam،,فَهَذَاthen theseلَمْdid notنَشْهَدْهُمْwitness them,وَلَاnorنَقَلَdid any transmitلَنَاto usأَحَدٌanyoneذَٰلِكَthis.
The second: One might say: Do you mean by the people of the language those you quoted like Abu Amr, Al-Asma'i, and Al-Khalil, and others like them, or those who speak with it? If you meant the former, then these do not transmit everything that was before Islam with a chain of narration; rather, they transmit what they heard from the Arabs in their time, and what they heard in the anthologies of poetry and the speech of the Arabs and other than that with a chain of narration, and we do not know in what they transmitted the term 'faith,' let alone that they united on it. And if you meant the speakers of this term before Islam, then these did not witness them, nor did anyone transmit this to us.
الثَّالِثُThe third::أَنَّهُis thatلَاthere is noيُعْرَفُknownعَنْaboutهَؤُلَاءِtheseجَمِيعِهِمall of themأَنَّهُمْthat theyقَالُواsaid::الإِيمَانُfaithفِيinاللُّغَةِthe language::هُوَisالتَّصْدِيقُaffirmation,بَلْratherوَلَاand no oneعَنْfromبَعْضِهِمsome of them،,وَإِنْand ifقَدَّرَone estimatesأَنَّهُthat itقَالَهُwas said byواحِدٌoneأَوْorاثْنَانِtwo,فَلَيْسَit is notهَذَاthisإِجْمَاعًاconsensus.
The third: it is not known about all of these that they said: faith in the language is affirmation; rather, not even about some of them. And if one estimates that it was said by one or two, this does not constitute consensus.
الرَّابِعُThe fourth::أَنْthatيُقَالَit is said::هَؤُلَاءِtheseلَاdo notيُنْقَلُونَtransmitعَنْaboutالْعَرَبِthe Arabsأَنَّهُمْthat theyقَالُواsaid::مَعْنَىthe meaningهَذَاof thisالْلَّفْظَtermكَذَاthusوَكَذَاand so،,وَإِنَّمَاratherيُنْقَلُونَthey transmitالْكَلَامَthe speechالْمَسْمُوعَheardمِنَfromالْعَرَبِthe Arabsوَأَنَّهُand that itيُفْهَمُis understoodمِنْهُfrom itكَذَاthus it is understood،,وَحِينََئِذٍand thenفَلَوْifقَدَّرَone estimatesأَنَّهُمْthat theyنَقَلُواtransmittedكَلَامًاa speechعَنْaboutالْعَرَبِthe Arabsيُفْهَمُthat is understoodمِنْهُfrom itأَنْthatالإِيمَانَfaithهُوَisالتَّصْدِيقُaffirmation,لَمْwould notيَكُنْbeذَٰلِكَthatأَبْلَغَmore eloquentمِنْthanنَقَلَthe transmissionالْمُسْلِمِينَof Muslimsكَافَّةًentireلِلْقُرْآنِfor the Quranعَنْfromالنَّبِيِّthe Prophet،,وَإِذَاand ifكَانَit wasمَعَwithذَٰلِكَthatأُرِيدَwas intendedبِهِby itمَعْنَىa meaningوَلَمْand notيُرَدَّbe rejectedفَقَدthen it mayيُظَنَّbe assumedبَعْضُهُمْby some of themذَٰلِكَthisفِي مَاin whatيُنْقَلُونَهُthey transmitعَنْfromالْعَرَبِthe Arabsأَوْلَىstronger.
The fourth: it can be said that these do not transmit from the Arabs that they said: the meaning of this term is such and such, but they transmit the heard speech from the Arabs and that it is understood from it as such. Thus, if it were assumed that they transmitted a speech from the Arabs understood to mean that faith is affirmation, that would not be more eloquent than the entire transmission of the Muslims for the Quran from the Prophet. And if, in addition, it was intended by it a meaning and was not rejected, then it may be assumed by some of them that this is stronger in what they transmit from the Arabs.
