بِإِسْنَادِهِWith his chain of narrationعَنْfromعُمَرَ،Omar,وَرَوَىand it was narratedعَنْfromالْحَسَنِAl-Hassanعَنْfromالنَّبِيِّthe Prophet(peace be upon him)مُرْسَلًا.as a mursal (unattributed narration)

With his chain of narration from Omar, and it was narrated from Al-Hassan from the Prophet (peace be upon him) as a mursal (unattributed narration).

وَفِيAnd inحَدِيثٍa narrationعَنْfromأَبِيAbuهُرَيْرَةَHurairaمَرْفُوعٍelevatedإِلَىtoالنَّبِيِّthe Prophet(peace be upon him):إِذَاWhenزَنَىa fornicatorالزَّانِيُthe fornicatorخَرَجَreturnsمِنْهُfrom himالإِيمَانُfaithفَكَانَand it wasكَالظِّلَّةِ،like a shade,فَإِنْand ifانْقَلَعَremovedرَجَعَreturnsإِلَيْهِto himالإِيمَانُfaith

And in a narration from Abu Huraira elevated to the Prophet (peace be upon him): When a fornicator fornicates, faith departs from him like a shade, and if it is removed, faith returns to him.

(١)(1) وَهَذَاThisإِنْifشَاءَGod willsاللَّهُAllahيَبْسُطُwill be elaboratedفِيinمَوْضِعٍanother placeآخَرَ..

فَصْلٌSection

Section

وَقَدْAnd thereجَاءَتْcameأَحَادِيثٌnarrationsتَنَازَعَthat disputeالنَّاسُpeopleفِيinصِحَّتِهَا،its authenticity,مِثْلَlikeقَوْلِهِhis saying: «لَا"There is noصَلَاةٌprayerإِلَّاexceptبِوُضُوءٍwith ablutionوَلَاand there is noوُضُوءٌablutionلِمَنْfor whomلَمْhas notيَذْكُرْmentionedاسْمَthe nameاللَّهِAllahعَلَيْهِ.upon him.(٢)(2)

And there came narrations that dispute people in their authenticity, like his saying: "There is no prayer except with ablution, and there is no ablution for whom has not mentioned the name of Allah upon him." (2)

فَأَمَّاAs forالأَوَّلُthe first:فَهُوَit isكَقَوْلِهِlike his saying: «لَا"There is noصَلَاةٌprayerإِلَّاexceptبِطَهُورٍwith purification.وَهَذَاThisمُتَّفَقٌis agreedعَلَيْهِupon itبَيْنَamongالْمُسْلِمِينَ.Muslims.فَإِنَّForالطَّهُورَpurityوَاجِبٌis obligatoryفِيinالصَّلَاةِ،prayer,فَإِنَّمَاand it is onlyنَفَىdeniedالصَّلَاةَthe prayerلِانْتِفَاءِdue to the absenceوَاجِبٍof the obligationفِيهاin it.

As for the first: it is like his saying: "There is no prayer except with purification." This is agreed upon among Muslims. For purity is obligatory in prayer, thus the prayer is denied due to the absence of the obligation in it.

وَأَمَّاAnd as forذِكْرُmentioningاسْمَthe nameاللَّهِAllahتَعَالَىthe Exaltedعَلَىuponالْوُضُوءِ،the ablution,فَفِيthere is a disputeوُجُوبِهِabout its obligation,مَعْرُوفٌwell-knownوَأَكْثَرُand mostالعُلَمَاءُscholarsلَاdo notيُوَجِّبُونَهُ،obligate it,وَهُوَand it isمَذْهَبٌthe view ofمَالِكٍ،Malik,وَأَبِيand AbuحَنِيفَةَHanifahوَال-Shَّافِعِيِّand Al-Shafi'iوَهُوَand it isإِحْدَىone ofالرَّوَايَتَيْنِthe two narrationsعَنْfromأَحْمَدَ،Ahmad,اخْتَارَهَاchosen byالْخَرْقِيَّAl-Kharqiوَأَبُوand AbuمُحَمَّدٍMuhammadوَغَيْرِهِمَاand others.

And as for mentioning the name of Allah upon the ablution, there is a dispute about its obligation, well-known, and most scholars do not obligate it, and it is the view of Malik, Abu Hanifa, and Al-Shafi'i. And it is one of the two narrations from Ahmad, chosen by Al-Kharqi, Abu Muhammad, and others.

وَالثَّانِي:And the second:يَجِبُis requiredوَهُوَand it isقَوْلُthe saying ofطَائِفَةٍa groupمِنَfromأَهْلِthe scholars ofالعِلْمِ،knowledge,وَهُوَand it isالرِّوَايَةُthe narrationالأُخْرَىthe other oneعَنْfromأَحْمَدَAhmadاخْتَارَهَاchosen byأَبُوAbuبَكْرٍBakrعَبْدِAbdulالعَزِيزِAzizوَالْقَاضِيand the judgeأَبُوAbuيَعْلَىYa'laوَأَصْحَابِهِ.and his companions.

And the second: is required and it is the saying of a group of scholars of knowledge, and it is the other narration from Ahmad, chosen by Abu Bakr Abdul Aziz and the judge Abu Ya'la and his companions.

وَكَذَلِكَSimilarly,قَوْلُهُhis saying: لَا"There is noصَلَاةٌprayerلِجَارٍfor the neighborالْمَسْجِدِof the mosqueإِلَّاexceptفِيinالْمَسْجِدِ.the mosque.رَوَاهُNarrated byالدَّارَقُطْنِيُّ،Al-Daraqutni,فَمَنْand someالنَّاسِpeopleمِنْamongيَضْعِّفُهُweakens itمَرْفُوعًاas elevatedوَيَقُولُ:and says: هُوَit isمِنْfromكَلَامِthe words ofعَلِيٍّAliرَضِيَ اللَّهُ عَنْهُ،may Allah be pleased with him,وَمِنْهُمْand among themمَنْare those whoيُثْبِتُهُaffirm itكَـعَبْدٍlike Abdulالْحَقِّ.Al-Haqq.(٣)(3)

Similarly, his saying: "There is no prayer for the neighbor of the mosque except in the mosque." Narrated by Al-Daraqutni, and some people among them weaken it as elevated and say: it is from the words of Ali, may Allah be pleased with him, and among them are those who affirm it like Abdul Haqq.

وَكَذَلِكَSimilarly,قَوْلُهُhis saying: لَا"There is noصِيَامٌfastingلِمَنْfor whomلَمْhas notيَبِتْspent the nightالصِّيَامَfastingمِنَfromاللَّيْلِ.the night.رَوَاهُNarrated byأَهْلُthe people ofالسُّنَنِ،the Sunnah,وَقِيلَ:and it is said: إِنَّthatالرَّفْعَits elevationلَمْhas notيَصِح،be authentic,وَإِنَّمَاbut ratherيَصَحُّit is authenticمَوْقُوفًاas something stoppedعَلَىonابْنِIbnعُمَرَUmarأَوْorحَفْصَةَ،Hafsah,فَلَيْسَthen it is notلِأَحَدٍfor anyoneأَنْto establishيُثْبِتَan affirmationلَفْظًاliterallyعَنْfromالرَّسُولِthe Messengerمَعَwhileأَنَّهُthat heأُرِيدَintendedبِهِby itنَفْيَto negateالكَمَالِthe completenessالْمُسْتَحَبِّ،that is recommended,فَإِنْfor ifصَحَّتْthey are authenticهَذِهِtheseالأَلْفَاظُwordsدَلَّتْthey indicateقَطْعًاcertainlyعَلَىonوُجُوبِthe obligationهَذِهِof theseالأُمُورِ،matters,فَإِنْfor ifلَمْnot

Similarly, his saying: "There is no fasting for anyone who has not spent the night fasting." Narrated by the people of the Sunnah, and it is said: that its elevation has not been authentic, but rather it is authentic as something stopped on Ibn Umar or Hafsah. Then it is not for anyone to establish a literal affirmation from the Messenger while he meant by it to negate the completeness that is recommended, for if these words are authentic, they certainly indicate the obligation of these matters.

(٤)(4) قَدْhasصَحَّbeen authenticمَوْقُوفًاas something stoppedوَمَرْفُوعًا،and elevated,وَالرَّفْعُand the elevationزِيَادَةٌis an additionلَاthat does notتُنَافِيcontradictالْوَقْفَthe stopping.[انظر[SeeإرواءErwaالغَلِيلِ»Al-Ghalil"٩١٤].914].

(4) It has been authentic as something stopped and elevated, and the elevation is an addition that does not contradict the stopping. [See Erwa Al-Ghalil" 914].
