لَكِنَّButزَادَincreasedفِيinأَحْكَامِهَاits rulingsوَمَقْصُودَهُمand their intentionأَنْthatالإِيمَانُfaithهُوَisمُجَرَّدٌmereالتَّصْدِيقِbelief،,وَذَٰلِكَand thatيَحْصُلُoccursبِالْقَلْبِby the heartوَاللِّسَانِand the tongue،,وَذَهَبَتْand a third group wentطَائِفَةٌa groupثَالِثَةٌthirdإِلَىtoأَنْthatالشَّارِعَthe legislatorتَصَرَّفَbehavedفِيهَاin itتَصَرُّفًas the behaviorأَهْلِof the peopleالعُرْفِof custom،,فَهِيَit isبِالنِّسْبَةِin terms ofإِلَىtoاللُّغَةِlanguageمَجَازٌmetaphor،,وَبِالنِّسْبَةِand in terms ofإِلَىtoعُرْفِthe customالشَّارِعِof the legislatorحَقِيقَةٌis a reality.

But its rulings were increased, and their intention is that faith is merely belief, which occurs by the heart and the tongue. A third group went to say that the legislator behaved in it as the people of custom do; it is, in terms of language, a metaphor, and in terms of the legislator's custom, a reality.

وَالتَّحْقِيقُAnd the fact isأَنَّthatالشَّارِعَthe legislatorلَمْdid notيَنْقُلْهَاtransfer itوَلَمْand did notيُغَيِّرْهَاchange itوَلكِنَّbutاسْتَعْمَلَهَاhe used itمُقَيَّدَةًrestrictedلَاnotمُطْلَقَةًunrestricted،,كَمَاasيَسْتَعْمِلُhe usesنَظَائِرَهَاsimilar expressionsكَقَوْلِهِsuch as His sayingتَعَالَىthe Exalted::﴿وَلِلَّهِAnd for Allahعَلَىuponالنَّاسِthe peopleحِجُّis the pilgrimageالْبَيْتِto the house.))[آل عمران[Al-Imran::٩٧]97]فَذَكَرَSo he mentionedحَجًّاa special pilgrimageخَاصًّاspecific،,وَهُوَwhich isحَجُّthe pilgrimageالْبَيْتِto the House،,وَكَذَٰلِكَand likewiseقَوْلُهُHis saying::(فَمَنْ(So whoeverحَجَّperformed pilgrimageالْبَيْتَto the houseأَوِorأعْتَمَرَ)performed Umrah)[البقرة:[Al-Baqarah:١٥٨]158]

And the fact is that the legislator did not transfer it nor change it, but rather used it restricted and not unrestricted, just as he uses similar expressions such as His saying: "And for Allah upon the people is pilgrimage to the house." [Al-Imran: 97] He mentioned a specific pilgrimage, which is the pilgrimage to the House; likewise, His saying: "So whoever performs pilgrimage to the House or performs Umrah." [Al-Baqarah: 158]

فَلَمْSo notيَكُنْwasلَفْظُthe termالحَجِّpilgrimageمُتَنَاوَلًاapplicableلِكُلِّto everyقَصْدٍintention،,بَلْbutلِقَصْدٍfor a specific intentionمَخْصُوصٍspecifiedدلَّindicatedعَلَيْهِby itالَلَّفْظُthe termنَفْسَهُitselfمِنْwithoutغَيْرِchangingتَغْيِيرٍthe meaning ofالْلُّغَةِlanguage,,وَالشَّاعِرُand the poetإِذَاifقَالَhe saidأَشْهَدُI witnessمِنْofعَوْفٍOufحُلُولًاmany happeningsكَثِيرَةٍmanyيَحُجُّونَthat they perform pilgrimageسِبًّاto seekالزُّبَيْرِكَthe Zubair.المُزَعْفَرَةُMuzafara(١)(1)

Thus, the term pilgrimage was not applicable to every intention, but rather for a specific intention indicated by the term itself without changing the meaning of the language. And if the poet said: 'I witness many happenings of Ouf that they perform pilgrimage to seek the Zubair, the Muzafara.' (1)
